1. Subject matter and parties
These Terms and Conditions govern access to and use of the "Speak to Sofía" service (hereinafter, the Service), offered by Ulises Vera Ramos, based in Spain, contact email hola@hablaconsofia.com (hereinafter, the Provider).
By registering or using the Service, you agree to be bound by these terms. If you do not accept them, you must refrain from using the Service.
2. Description of the service
Speak to Sofía is a virtual companionship application designed for older adults. It allows voice conversations with digital avatars, scheduling of reminders, sending messages to family members, and access to adapted entertainment content.
The Service is provided through a monthly subscription. Available features depend on the plan purchased.
3. Subscription conditions
To subscribe to the Service you must:
— Be of legal age (18 years or older). — Provide a valid email address. — Have a valid payment method accepted by the payment platform (Stripe).
The contract is concluded when the Provider confirms payment and activates the subscribed plan. You will receive a confirmation email with the details of your subscription.
4. Pricing and billing
Prices are shown in euros (€) and include applicable tax.
Billing is monthly and renews automatically on the same day each month. You may cancel at any time from your account area; cancellation takes effect at the end of the already-paid period.
The Provider reserves the right to change prices with a minimum of 30 days' notice communicated by email.
5. Right of withdrawal
In accordance with EU consumer legislation, you have 14 calendar days from the date of subscription to withdraw from the contract without giving reasons, unless you have made effective use of the Service during that period, in which case the right of withdrawal may be limited.
To exercise this right, contact us at hola@hablaconsofia.com stating your intention to withdraw. We will confirm the cancellation and, where applicable, process any refund within a maximum of 14 days.
6. Permitted use and prohibitions
The Service is intended exclusively for personal, non-commercial use for the care and companionship of older adults.
The following are prohibited:
— Assigning, sub-licensing or reselling access to third parties. — Attempting to access features or data of other users. — Using the Service for illegal purposes or that may cause harm to third parties. — Reverse engineering, decompiling or modifying the software. — Intentionally overloading the Service infrastructure.
7. Availability and quality of service
The Provider strives to achieve 99% monthly Service availability, but cannot guarantee uninterrupted operation. Interruptions may occur due to maintenance, updates, or causes beyond the Provider's control (infrastructure provider failures, internet incidents, etc.).
In the event of prolonged interruptions attributable to the Provider, proportional compensation for the affected period will be assessed.
8. Limitation of liability
The Service is provided "as is". The Provider does not guarantee that AI-generated content will always be accurate, complete or appropriate for all situations.
The Service does not replace healthcare, psychological or social care professionals. In an emergency, call your local emergency number.
The Provider's liability to the user shall not in any case exceed the amount paid by the user in the last 3 months.
9. Intellectual property
All rights in the Service, its code, design, content, trademarks and avatars belong to the Provider or its licensors. Use of the Service does not transfer any intellectual property rights to the user.
The user retains ownership of the content they enter (name of the senior, messages, voice recordings) and grants the Provider a limited licence to process them solely for the purpose of providing the Service.
10. Changes to these terms
The Provider may update these Terms at any time. Material changes will be communicated by email with at least 15 days' notice. Continued use of the Service after the changes come into force constitutes acceptance of those changes.
If you do not accept the new terms, you may cancel your subscription before they take effect.
11. Dispute resolution and governing law
These Terms are governed by Spanish law. For dispute resolution, the parties submit to the courts of the user's place of domicile when the user is a consumer.
